Distributors currently engaged for the scope of work within the WAN Independent Distribution Contractor Agreement are required to provide a minimum standard for business operations. All Distributors must ensure that their business provides the standards detailed within this document in order to comply with Federal and State legislation (The Law).

There are ten mandatory business standards that are required from Distributors. These Standards are as follows:

  • Australian Business Number

Distributors must have a current active Australian Business Number (ABN) throughout the term of the agreement.

  • Taxation

Distributors are required to provide an Australian Business Number that is registered for GST throughout the term of the agreement.

  • Workers' compensation insurance

The Distributor will comply with any obligations to take out a Sick and Accident coverage policy for themselves. Any employees of the Distributor shall be covered for workers’ compensation in accordance with Work Cover W.A.

  • Public Liability Insurance

Legal liability in respect to third party property damage or bodily harm for an amount no less than $10,000,000 ($10 million) for any one occurrence.

  • Automotive Insurance

Automobile liability insurance for each vehicle used in the performance of the Agreement -- including owned, non-owned (for example, owned by Contractor's employees), leased, or hired vehicles.

  • Licence

The Distributor and all of the Distributor’s employees working with the Agreement must hold a current Western Australian Driver’s Licence for the operation of the Vehicle type under their control.

The Distributor will provide WAN copies of all Licences (including all conditions attached to them) for the Distributor and all of the Distributor’s employees working with the Agreement.

  • Vehicle

The Distributor will provide vehicles, which are licenced under the relevant legislation and are appropriate to perform the services of the agreement

The Distributor will provide WAN copies of vehicle registration documents for the vehicles working with the Agreement.

  • Rights to Work

A Distributor providing services to WAN must ensure that each person employed or sub-contracted to provide the services under the agreement is allowed to work in Australia.

A person who is allowed to work in Australia is one of the following:

  • An Australian citizen; or
  • Non-citizen with a valid Australian visa that allows the person to work in Australia.
  • Electrical, Equipment and Machinery

The use of all electrical items, machinery or equipment to complete work in the agreement, the Distributor must:

  • Ensure all standard safety guarding is installed on machinery
  • Where applicable, ensure emergency stop button is installed on machinery
  • Rolling Machines are to be properly stabilized at safe working height
  • Safety Management System

Distributors are required to create, implement and monitor the safety management system that is consistent with the risk associated with the size and scope of the Works, the number of parties involved in the work, the likely duration of the Works and their cost, and their potential impact on the health and / or safety of other persons. Systems are to be implemented prior to 31 December 2018.
